These Terms and Conditions (“Terms”) govern your access to and use of the websites, online portals, and related online services operated by BCW Financial LLC (“BCW Financial,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. 1. Nature of services; not an insurance contract or advice

Information on the Site is for general informational and marketing purposes only and does not modify, amend, or replace any insurance policy, contract, endorsement, declarations page, or other written agreement issued by or through BCW Financial. Coverage, if obtained, is governed solely by the terms and conditions of the actual policy or contract issued to you by the applicable insurance carrier.

Unless expressly stated in writing in a separate agreement with you, nothing on the Site constitutes:

2. Insurance licensing and carrier disclosures

BCW Financial LLC is an insurance agency and marketing organization based in Georgia. Insurance products described on the Site may be underwritten by one or more third‑party insurance companies. References on the Site to specific carriers or products are for marketing purposes and do not guarantee that coverage will be offered to any particular applicant.

BCW Financial and its producers are licensed only in certain states. Availability of products and services, and producer compensation, may vary by state and by carrier. Nothing on the Site is intended to solicit, negotiate, or sell insurance in any jurisdiction where BCW Financial or the relevant producer is not properly licensed or where such solicitation would be unlawful.

If you apply for coverage, the applicable carrier’s policy, application, and disclosures will control, and additional terms and conditions will be provided to you at that time.

3. Eligibility and user responsibilities

4. No client, agency, or fiduciary relationship created

Your use of the Site, including submitting a form or requesting a quote, does not by itself create an insurance producer‑client relationship, a fiduciary relationship, or any agency relationship between you and BCW Financial beyond that which may be established in a separate written agreement or carrier appointment. Any such relationship will arise, if at all, only after required applications, disclosures, and agreements are completed and accepted.

5. Intellectual property

All content on the Site, including text, graphics, logos, icons, images, software, and their arrangement (collectively, “Content”), is owned by or licensed to BCW Financial and is protected by U.S. and international intellectual property laws. You may view and print Content for your personal, non‑commercial use related to evaluating or using our products and services, but you may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit the Content without our prior written permission.

Trademarks, service marks, and logos displayed on the Site are the property of BCW Financial or third parties, and no license or right is granted by implication or otherwise.

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BCW FINANCIAL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error‑free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BCW FINANCIAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT OR SERVICES MADE AVAILABLE THROUGH IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF BCW FINANCIAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BCW FINANCIAL’S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100) OR, IF GREATER, THE AMOUNTS YOU PAID DIRECTLY TO BCW FINANCIAL FOR THE SPECIFIC SERVICE FROM WHICH THE CLAIM AROSE DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION 10 SHALL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND SHALL APPLY TO THE FULLEST EXTENT PERMITTED IN THE STATES OF GEORGIA AND NORTH CAROLINA, BUT SHALL NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
